These terms cover Earshot Plus and tryearshot.app, provided by [LEGAL ENTITY / SOLE TRADER NAME, ABN XX XXX XXX XXX] ("we", "us"). The open-source desktop app is licensed separately under the MIT licence on GitHub; these terms apply to the paid service, not the code.
1. The service
Earshot Plus provides managed transcription and AI processing for the Earshot desktop app, subject to a fair-use allowance (currently 40 hours of transcription per month, stated at purchase). We may adjust models and infrastructure to keep quality and cost sensible; material reductions to your allowance will be notified a billing cycle in advance.
2. Accounts
You need an account and an active subscription. Keep your credentials private; you're responsible for activity on linked devices. You can revoke a device from your account page at any time.
3. Billing
Subscriptions are sold by Paddle, our merchant of record. Paddle's terms apply to the transaction, and applicable taxes are added at checkout. Plans renew automatically until cancelled. 4. Acceptable use
Don't use the service to break the law, including recording people where you lack the right or required consent to do so (recording-consent laws vary by place; that compliance is yours). Don't probe, overload, resell or wrap the API, attempt to extract our provider credentials, or submit content designed to attack the systems processing it. We can suspend accounts that do.
5. Your content
Your meetings are yours. You grant us only the transient right to process submitted audio/text through our AI providers to return your results. We claim no ownership and don't use your content for training or anything else.
6. Availability and changes
We aim for boring reliability but the service is provided "as is", small-team software with third-party model providers upstream. We may change or discontinue features; if we discontinue Plus entirely we'll give 60 days' notice, and the self-hosted app keeps working forever regardless.
7. Liability
To the extent the law allows (and without excluding rights under the Australian Consumer Law that cannot be excluded), our total liability is capped at the amount you paid us in the 12 months before the claim, and we're not liable for indirect or consequential losses, including decisions made on the basis of AI-generated notes. Transcripts and notes are AI output: check them before you rely on them.
